FOURTH CHAPTER
ULTIMATE AUTHORITY AND POWER

Article 9: Ultimate Authority, Source of Policies and Regulations, and Power

  1. The Ultimate Authority and the source of policies and regulations for the Development Party is the Quran and the Sunnah (Traditional Practice) of the Prophet Muhammad (SAW).
  2. Any Chapter, Article or Clause in the Constitution of the Development Party which conflicts with the Quran and the Sunnah of the Prophet Muhammad (SAW) shall accordingly be null and void.
  3. Subject to Clause 1 and Clause 2, Article 9, all activities and administrative acts of the Development Party shall be carried out under the authority and direction of the Annual General Congress or a Special General Congress, and such an Annual or Special General Congress shall be subject to the conditions stated in the Constitution of the Development Party and the regulations governing the Annual or Special General Congress itself.

 

 
 
 
     
     
 

FIFTH CHAPTER
MEMBERSHIP

Article 10: Qualifications for Membership

  1. Subject of His Majesty the King and Ruler.
  2. At least eighteen years of age.
  3. Acceptance of the Constitution of the Party and the regulations made under it.
  4. Not a member of any other political party.
  5. pproved by the Supreme Council of the Development Party , hereinafter referred to as the “Supreme Council”, or the Central Executive Council.

Article 11: Procedure of Applications for Membership

  1. Complete the application form to become a member of the Development Party.
  2. Pay the Membership Entrance Fee of Ten Brunei Ringgit.
  3. Pay the Annual Membership Subsciption of Five Brunei Ringgit for the first year.
  4. Be proposed by a member and seconded by another member.
  5. Send the duly completed application form to the Supreme Council or the Central Executive Council for its approval.
  6. Each member approved by the Supreme Council or the Central Executive Council will be issued a membership certificate or card signed by the President or Secretary-General of the Development Party.

Article 12: Termination of Membership

  1. Membership in the Party will terminate when a member applies to resign as a member of the Development Party and such an application is duly approved by the Supreme Council.
  2. Membership in the Party will terminate when a member is removed or deprived of his membership by the Supreme Council for any reason whatsoever, after such removal or deprivation has been supported by the Discipline and Moral Conduct Committee and after the completion of the appeal process within a reasonable time frame.
  3. Membership in the Party will terminate when a member dies.
  4. Membership in the Party will terminate when a member becomes prohibited from membership by reason of the application of any law of the Nation State of Brunei Darussalam.

Article 13: Membership Rights

  1. Right to elect and be elected to any position in the Development Party at all levels, including the central, divisional and branch levels.
  2. Right to offer opinions and suggestions and to freely express views within the Party.
  3. Right to attend all official and unofficial rallies and assemblies of the Party.
  4. Right to receive whatever welfare facilities and services from the Development Party from time to time.

Article 14: Membership Duties and Obligations

  1. To pay the membership fees and to abide by the decisions of the Party from time to time.
  2. To carry out the directions and commands of the party leadership from time to time.
  3. To attend courses, training sessions, congresses/ assemblies/ meetings of the Party as and when held and directed to do so.
  4. To seek useful knowledge, including Islamic religious sciences and the art of governance, from time to time.
  5. To preserve the good name of the counry and the Party whilst being within or without the borders of the country.
  6. In general, to fulfill the requirements of the party constitution from time to time.

Article 15: Registers of Members

  1. The Headquarters of the Development Party at the central level, as well as every division and branch office, shall maintain a membership database or register of members containing for every member particulars of name, address, identity card number, occupation and the serial number of the membership certificate or card and other details as required by the party Secretary-General from time to time.
  2. The party Secretary-General, with the concurrence of the Central Executive Council is empowered to make any regulation regarding the membership database and the register of members.
